Intellectual Property Policy

At Begja, we respect the intellectual property (IP) rights of others and expect all users—sellers and buyers alike—to do the same. This Intellectual Property Policy outlines our approach to copyright, trademarks, and other proprietary rights, and provides a process for IP rights holders to report potential violations on the platform.


1. General Statement

Begja is a user-generated marketplace, which means content (product listings, images, descriptions, branding) is uploaded directly by independent sellers. Sellers are fully responsible for ensuring that the content and products they upload:

  • Do not infringe on copyrights, trademarks, design rights, or patents

  • Are either owned by the seller or used with explicit permission or licensing

  • Do not violate any applicable intellectual property laws


2. Prohibited Use

The following are strictly prohibited on Begja:

  • Selling counterfeit or pirated goods

  • Using copyrighted product photos, logos, or descriptions without authorization

  • Listing replicas or “inspired” versions of branded goods without consent

  • Using brand names or trademarks deceptively in listings, tags, or shop names

  • Reselling licensed or digital goods without verified resale rights

Violations may result in content removal, account suspension, or permanent ban.


3. Reporting IP Infringement

If you are an intellectual property rights holder, or legally authorized to act on behalf of one, you may report content on Begja that you believe infringes your rights.

Please include the following:

  • Your full legal name and contact information

  • Identification of the intellectual property right being infringed (e.g., copyright registration, trademark ID)

  • URL(s) or listing(s) in question

  • A statement that you have a good faith belief that the content is not authorized

  • A declaration that your notice is accurate and that you are the rights holder (or authorized agent)

Begja may share your report with the seller involved.


4. Counter-Notice Process

If a seller believes their listing was removed in error, they may submit a counter-notice to:
legal@begja.com

A valid counter-notice must include:

  • Your full name and contact information

  • The listing that was removed and why you believe it does not infringe

  • Proof of rights or licenses, if applicable

  • A statement under penalty of perjury that you have the right to sell the item

  • Your agreement to submit to jurisdiction in case of legal dispute

We will review the notice and may restore the content if appropriate.


5. Repeat Infringer Policy

Begja maintains a zero-tolerance policy for repeat intellectual property violations. Accounts found to repeatedly infringe IP rights will be:

  • Permanently suspended

  • Blacklisted from re-registering

  • Reported to appropriate legal authorities (if applicable)


6. Seller Best Practices

To avoid violations, sellers are advised to:

  • Use original product photos and branding

  • Avoid using third-party brand names unless you are authorized or reselling authentic goods

  • Keep documentation of all licenses, permissions, or reseller agreements

  • Be cautious when using supplier-provided content

Begja reserves the right to request proof of ownership or authorization at any time.


7. Begja's Role

Begja is a neutral intermediary under applicable internet platform laws (e.g., DMCA, e-Commerce Directive). We:

  • Respond to valid IP takedown notices

  • Do not independently review or verify each product listing before publication

  • Remove content only upon proper notification by rights holders

  • Cooperate with law enforcement and legal authorities where appropriate
